Municipal Coordination

Zoning Reviews determine the feasibility of the project from a zoning and planning perspective. Items covered during a review include:

  • Zoning designation
  • Setback requirements
  • GFA and Height limits
  • Determine if a Minor Variance is required to permit construction
  • Site Plan Approval (if required; varies by municipality & site plan controlled areas)
  • Conservation Authority Approval (if required)
  • Building Permit Facilitation

From submittal to approval, we take care of the process every step of the way.

Zoning Designation Review: This involves a detailed analysis of the property's current zoning classification. This step assesses how the land can be used under the existing zoning laws and identifies any restrictions or allowances that are applicable to the project. It's crucial to understand if the land is zoned for residential, commercial, industrial, or mixed-use, as this will significantly influence the project's scope and design.

Setback Requirements Analysis: Setback requirements dictate the distance a building or structure must be set back from a street, road, or other established lines. This step involves measuring these distances to ensure compliance with local regulations, which can vary greatly depending on the area.

Gross Floor Area (GFA) and Height Limits Assessment: GFA refers to the total area within the perimeter of a building, excluding the external walls. Height limits are the maximum allowable height for a building in a particular zone. This review ensures that the proposed project adheres to these limits, which are critical in maintaining the character and skyline of the area.

Minor Variance Determination: If the project does not fully comply with zoning regulations, a minor variance may be required. This process involves an assessment to determine if the project’s deviations from the zoning bylaws are minor and if they meet the four tests set out in the Planning Act.

Site Plan Approval Process: In certain municipalities and for specific types of developments, site plan control may be applicable. This process involves a detailed review of how a site will be developed, including the layout of buildings, parking, landscaping, and the impact on the surrounding area. It often requires consultations with various municipal departments.

Conservation Authority Approval: If the project is within a regulated area, approval from the local Conservation Authority may be necessary. This step involves ensuring that the project does not adversely affect natural resources, conforms to floodplain management policies, and aligns with other environmental considerations.

Building Permit Facilitation: This comprehensive service includes managing the submission of building permit applications, ensuring all necessary documentation is complete and accurate, liaising with local authorities throughout the review process, and addressing any issues that arise to secure approval. This step is critical in transitioning from planning to the actual construction phase.

Each of these steps is essential in ensuring that a construction project is feasible, compliant with all regulations, and ready for successful implementation. Understanding and navigating these complex processes is vital for any development project.
